Eleven AGs ask Supreme Court to hear appeal

Montana’s Attorney General has filed an amicus brief, asking the U.S. Supreme Court to hear Arizona’s appeal in the case of Brewer v Nader, where the 9th circuit struck down Arizona’s ban on out-of-state circulators. The brief was co-signed by attorney generals from Alabama, Alaska, Colorado, Delaware, Florida, Idaho, Michigan, New Hampshire, Ohio, Oklahoma, South Dakota, and Wyoming.

The amicus brief, filed December 17, focuses primarily on the issue of out-of-state circulators, although the Brewer v Nader ruling also struck down Arizona’s early June petition deadline for independent candidates.

Richard Winger at Ballot Access News noted that is odd that Alabama, Delaware, Florida, and New Hampshire signed the amicus, because those four states don’t currently prohibit out-of-state petition circulators.
