The U.S. Court of Appeals for the 10th Circuit today denied Oklahoma Attorney General Drew Edmondson’s appeal of the ruling that struck down Oklahoma’s residency requirement as unconstitutional. Edmondson has accused the Oklahoma 3 of violating this requirement, leading to his pending indictment of the three.

In denying Edmondson’s request for rehearing, not a single judge on the 10th Circuit argued in favor of Edmondson’s motion to rehear.

“I had thought his motion would be denied,” Paul said in reaction to today’s ruling, “but I’m a little surprised that it did not have a single advocate on the entire circuit court.

An attorney working on the case was quoted as saying, “This order denying rehearing makes it even less likely that the Supreme Court would take this up.”

Let’s hope AG Edmondson will finally see the wisdom in dropping this ridiculous prosecution!
